MEDAT unlocks electronic signature regulations and trust services

Ministry of Economy, Digitalization, Entrepreneurship and Tourism (MEDAT) has announced the unblocking of regulations governing electronic signatures and trust services, aiming to restore market predictability and remove bureaucratic obstacles that delayed the law’s implementation. The ministry has committed to an accelerated timeline for issuing the required secondary legislation.

“MEDAT is focused on continuously updating the legal framework in line with the adoption of European implementing acts, ensuring compliance with the security requirements related to electronic signatures. In the immediate period ahead, on an urgent basis, we intend to harmonize national legislation to align with the European eIDAS2 regulation,” the ministry stated.

The decision follows consultations with private sector representatives and discussions held at government level, including with Deputy Prime Minister Oana Gheorghiu.

Market liberalization and next steps

“Through this order, we put an end to an excessively long waiting period and finally unlock Romania’s digital potential. Liberalizing the electronic signature is a reform we have made a priority. This order genuinely liberalizes electronic signatures for both providers and citizens. The most important benefit is that Romanians will be able to sign many more types of documents using advanced electronic signatures. The next steps are clearly assumed: we will amend the law to align it with eIDAS 2.0 and adjust the related regulations so that the rules are simple, clear, and easy to apply in practice. Only in this way can we give people the freedom to interact digitally with the state and the private sector,” said Irineu Darău, Minister of Economy, Digitalization, Entrepreneurship and Tourism.

MEDAT also announced the entry into force of a key regulatory package for Romania’s digital architecture, approving authorization, supervision, and control procedures for trust service providers. The ministerial order, published in the Official Gazette of Romania, operationalizes Law No. 214/2024 and establishes a competitive and transparent framework that liberalizes the market.

The new rules set clear conditions for economic operators providing qualified and non-qualified trust services, simplify registration procedures, and reduce technical and administrative barriers. For citizens, the framework expands recognition of electronic signatures, regulates digital document validation, and enables remote identification and signature issuance without physical presence, under strict security standards. The order will enter into force within 60 days.
